Terms and Conditions for Selling on wix Wine and Champagne Glasses for Manshya Enterprises (Parent Company) - Luxrify:
Introduction These Terms and Conditions govern the sale of wine and champagne glasses by Manshya Enterprises (hereinafter "the Seller") through the wix Wine platform in the USA. By placing an order with the Seller, the Buyer agrees to these Terms and Conditions. The Seller reserves the right to modify these Terms and Conditions at any time without prior notice.
Ordering and Payment
2.1 Orders may be placed through the wix Wine platform, and payment must be made at the time of purchase. The Seller accepts major credit cards and PayPal as forms of payment.
2.2 Once an order is placed, the Seller will send a confirmation email to the Buyer with the details of the order, including the purchase price, shipping address, and estimated delivery date.
2.3 If the Seller is unable to fulfill the order for any reason, the Seller will notify the Buyer and provide a full refund.
Shipping and Delivery
3.1 Shipping is available within the USA only. The shipping cost will be added to the purchase price at the time of checkout.
3.2 The estimated delivery date will be provided to the Buyer at the time of purchase. The Seller will use commercially reasonable efforts to ensure that the product is delivered by the estimated delivery date, but the Seller is not liable for any delay or failure to deliver the product on the estimated delivery date.
3.3 The Buyer is responsible for providing accurate shipping information. If the Buyer provides incorrect shipping information, the Seller is not responsible for any delay or failure to deliver the product.
Returns and Refunds
4.1 If the Buyer is not satisfied with the product, the Buyer may request a return within 14 days of delivery. The Buyer is responsible for the cost of return shipping.
4.2 The product must be returned in its original condition, with all original packaging and accessories, to be eligible for a refund.
4.3 The Seller will issue a refund for the purchase price of the product, less any shipping costs, within 14 days of receiving the returned product.
Product Information
5.1 The Seller makes reasonable efforts to ensure that the product information on the wix Wine platform is accurate and up to date. However, the Seller does not warrant that the product information is error-free.
5.2 The product images on the wix Wine platform may differ from the actual product due to variations in computer monitor settings and other factors.
Intellectual Property
6.1 The Seller owns all intellectual property rights in the product, including but not limited to trademarks, logos, and copyrighted material.
6.2 The Buyer agrees not to use the Seller's intellectual property without the Seller's prior written consent.
Limitation of Liability
7.1 To the extent permitted by law, the Seller is not liable for any direct, indirect, special, incidental, or consequential damages arising from the purchase or use of the product, including but not limited to loss of profits or revenue, loss of use of the product, or any third-party claims.
7.2 The maximum liability of the Seller to the Buyer is the purchase price of the product.
Governing Law and Jurisdiction
8.1 These Terms and Conditions are governed by the laws of the State of New Jersey.
8.2 Any dispute arising from the purchase or use of the product will be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
Entire Agreement These Terms and Conditions constitute the entire agreement between the Buyer and the Seller regarding the purchase of the product, and supersede all prior or contemporaneous agreements or understandings, whether written or oral.
